IT IS APPALLING THAT ONCE AGAIN THE FIREWORKS INDUSTRY IS RAMMING DOWN THE THROATS OF OHIO’S UNKNOWING CITIZENS YET ANOTHER PIECE OF PROPOSED LEGISLATION TO “LEGALIZE” FIREWORKS. THIS WILL RESULT IN INJURIES AND DEATHS OF THE INNOCENT PEOPLE OF THIS GREAT STATE CONNED INTO PLAYING WITH DANGEROUS EXPLOSIVES IN THE NAME OF “SAFE CELEBRATION”. THE FIREWORKS INDUSTRY TURNS A “BLIND EYE”- (ODE TO BLINDNESS PREVENTION)- TO THE SERIOUS THREAT TO PUBLIC SAFETY AND WELFARE DUE TO THE POSSIBILITY OF INCREASED REVENUES. HOW MANY OF YOU RECEIVE SIGNIFICANT CAMPAIGN “CONTRIBUTIONS” FROM THE FIREWORKS INDUSTRY? HOW MANY MORE $MILLIONS DO THESE FOLKS NEED TO MAKE FOR THEIR STRENUOUS 60 DAY WORK YEAR? MUST BE NICE TO WORK TWO MONTHS OUT OF THE YEAR…..OPERATING A…..STATE SUPPORTED…..MONOPOLY.(MORE TO COME ON THIS UNCONSITUTIONAL MONOPOLY.)
{THE LEGISLATIVE SERVICES COMMISSION SHOULD PROHIBIT THE REVISED CODE FROM UTILIZING OHIO BUILDING CODE TERMINOLOGY IN REFERRING TO VARIOUS OCCUPANCIES. LET THE ADMISISTRATIVE CODES BOTH THE OHIO BUILDING CODE AND THE OHIO FIRE CODE FOLLOW THE INTERNATIONAL CODE COUNCIL NOMENCLATURE, NOT PLACING SUCH TERMS INTO THE REVISED CODE. THIS HAS ALREADY CAUSED HAVOC WITH THE LICENSURE REQUIREMENTS OF HOTELS/MOTELS, YMCA’S SRO’S AND EXTENDED STAY HOTELS.}

AS I WAS AN ASSISTANT STATE FIRE MARSHAL AT THE TIME….I WAS ON SCENE THAT FATEFUL DAY IN JULY OF 96. I WALKED AMONG THE BODIES STREWN ON THE DRIVEWAY WHILE FIREFIGHTERS WERE STILL CONDUCTING OPERATIONS. I WITNESSED THE TOTAL DESTRUCTION AND THE CARNAGE.
NOW, YOU MIGHT WONDER….JUST HOW COULD NEARLY A DOZEN OF OHIO’S CITIZENS PERISH IN A BUILDING THE SIZE OF YOUR TWO CAR GARAGE IN A MATTER OF MINUTES WHEN IT CONTAINED ONLY THESE….”SAFE AND SANE” FIREWORKS?– (EXPLOSIVE DEVICES.) — YES…FIREWORKS…..ARE……EXPLOSIVE DEVICES. “SAFE AND SANE”….SURE. TRUTH IN ADVERTISING …AT ITS BEST…
WELL, APPARENTLY THE OWNER/OPERATORS WERE USING THE SPRINKLER SYSTEM WATER FOR CAR WASHING. ALTHOUGH …FELONY STUPID…PROBABLY WOULDNT HAVE MADE ANY DIFFERENCE…(SEE THE GOVERNORS TASK FORCE ON SPRINKLER SYSTEMS FOR FIREWORKS FACILITIES FINAL REPORT.)…SPEAKING OF FELONIES… I WAS ONE OF SEVERAL ASSISTANT STATE FIRE MARSHALS THAT COINCIDENTALLY WERE AT THAT VERY FIREWORKS FACILITY JUST A NUMBER OF DAYS PRIOR TO THE TRAGIC FIRE BECAUSE WE HAD RECIEVED A TIP THAT THE OWNER/OPERATORS WERE SELLING PROFESSIONAL GRADE 10 INCH AND 12 INCH MORTAR SHELLS TO INDIVIDUALS THAT DID NOT POSSESS THE REQUISITE PYROTECHNICS SHOOTER LICENSE. SURE ENOUGH, WE SUCCESSFULLY COMPLETED AN UNDERCOVER BUY /BUST, PURCHASING A LARGE EXPLOSIVE CLASS B MORTAR SHELL WITHOUT EVEN BEING ASKED IF WE WERER LEGALLY ALLOWED TO OBTAIN IT OR IF ONE OF US HAD A PROPER PYROTECHNICS SHOOTER LICENSE. RED WHITE AND BOOM! IT COULD HAVE BEEN YET ANOTHER TRAGEDY IF SOME OTHER BUYER OBTAINED SUCH SHELLS AND DID NOT KNOW HOW TO HANDLE THEM. (RED WHITE AND BUSTED!)
FIRST, THERE WAS THE PREDICTABLE KNEE JERK LEGISLATION IN OHIO TO MAKE ALL FIREWORKS RETAIL SHOWROOMS “SAFE”. LEGISLATIVE MANDARTE: LETS ADD SOME SMOKE EXHAUST FANS. LETS IGNORE THE FACT THAT WE HAVENT DONE ANY FULL-SCALE LIVE FIRE TESTING WITH LIVE PRODUCT TO ENSURE THAT SMOKE EXHAUST FANS ARE COMPATIBLE WITH A SPRINKLER SYSTEM TO PROTECT SUCH A DANGEROUS COMMODITY. MOREOVER, WHAT TYPE OF SPRINKLER SYSTEM SHOULD BE UTILIZED?I WAS APPOINTED BY THE GOVERNOR TO SERVE ON A TASK FORCE TO DETERMINE IF ALL FIREWORKS FACILITIES SHOULD BE PROTECTED BY SPRINKLER SYSTEMS AND IF SO, WHAT TYPE. INDUSTRY REPRESENTATIVES, FIRE PROTECTION ENGINEERS, WE ALL WORKED TOGETHER ON THE TASK FORCE. THE TASK FORCE AGREED THAT FULL-SCALE LIVE FIRE AND LIVE PRODUCT TESTING NEEDED TO OCCUR. THE LIVE FIRE TESTING PROJECT WAS BID ON BY SEVERAL RESEARCH ORGANIZATIONS INCLUDING SOUTHWEST RESEARCH INSTITUTE, GBH INTERNATIONAL AND BATELLE INSTITUTE. THE ACTUAL LIVE FIRE TESTING PROTOCOLS WERE DEVELOPED AND DIRECTED BY FIRE PROTECTION ENGINEER MIKE GOLLY – BATTELLE INSTITUTE. THE LIVE FIRE TESTING OF FIREWORKS AND SPRINKLER SYSTEMS WAS CONDUCTED AT ABERDEEN PROVING GROUNDS, ABERDEEN MARYLAND. THE TASK FORCE BASICALLY RECREATED THE SCOTTOWN SCENARIO, BUT THIS TIME, WITH A WORKING SPRINKLER SYSTEM. A TEST ROOM ABOUT THE SIZE OF A TWO CAR GARAGE WAS OUTFITTED WITH APPROPRIATE RETAIL SHELVING AND FIREWORKS DISPLAYS. THE INDUSTRY REPRESENTATIVES ENSURED A TRUE TO LIFE “RETAIL” SHOWROOM WAS REPLICATED WITH ONLY “OHIO LEGAL” FIREWORKS ON THE SHELVES. YET WE WERE CAREFUL NOT TO INCLUDE THE FAILURES PRESENT AT SCOTTOWN LIKE PRODUCT STACKED TO CEILING, OVERSTOCKED SHELVES, ETC.EVEN WITH LESS PRODUCT IN THIS APPROX 1,000 SQ FT TEST ROOM, THE LIVE FIRE TEST WAS UNBELIEVABLY DESTRUCTIVE. THE EXPLOSIVE NATURE OF THE “SAFE AND SANE” FIREWORKS COMMODITY WAS READILY APPARENT AS THE FIRE RAPIDLY DEVELOPED WITH DESTRUCTIVE VIOLENCE, TREMENDOUS FORCE AND OVERWHELMING SMOKE PRODUCTION. THE RATE OF FIRE GROWTH AND SMOKE PRODUCTION RENDERED THE ROOM UNTENABLE IN UNDER TEN (10) SECONDS. IN UNDER TEN (10) SECONDS THE SMOKE LAYER HAD DROPPED ALL THE WAY TO FLOOR LEVEL. (HOW DOES ONE….”CRAWL UNDER SMOKE” WITH THIS COMMODITY?…HMMM….NO WONDER THE CUSTOMERS AT THE SCOTTOWN STORE COULDN’T MAKE IT OUT IN TIME TO STAY ALIVE…) THE FULL-SCALE TEST FIRE BURNED WITH SUCH INCREDIBLE VIOLENCE AND INTENSITY THAT THE “STANDARD” SPRINKLER SYSTEM WAS QUICKLY OVERRUN AND THE FIRE PROTECTION ENGINEERS CONDUCTING THE TEST FEARED THAT THE BUILDING HOUSING THE TEST FIRE ROOM WAS AT RISK AND MANUALLY OPENED THE BUILDING SPRINKLERS LOCATED ABOVE THE TEST ROOM.. TO SAVE THE TESTING BUILDING. PERHAPS THE “STANDARD” SPRINKLER SYSTEM THE INDUSTRY TOUTS AS APPROPRIATE FOR THIS COMMODITY…..REALLY….ISN’T.PREDICTABLY, THE GOVERNOR’S TASK FORCE FINAL REPORT OF ITS FINDINGS WAS LARGELY SWEPT UNDER THE RUG BY THE INDUSTRY AND IGNORED OR QUICKLY FORGOTTEN BY STATE OFFICIALS. ALTHOUGH THE VIDEO AND THE TEST FINDINGS WERE SHARED WITH FIRE AND BUILDING CODE OFFICIALS NATIONWIDE.
I IMPLORE YOU TO OBTAIN FROM THE STATE FIRE MARSHAL A COPY OF THE VIDEO TAPE OF THE LIVE FIRE TESTING AND A COPY OF THE FINAL REPORT OF THE GOVERNORS TASK FORCE TO STUDY SPRINKLER SYSTEMS PROTECTION FOR FIREWORKS FACILITIES IN OHIO.
FOR THE NEXT DECADE THERE WAS A NATIONWIDE PUSH TO DEVELOP FIRE SAFETY AND BUILDING CODE SAFETY REGULATIONS THAT WOULD PREVENT ANOTHER SCOTTOWN FIREWORKS TRAGEDY. I PERSONALLY SPENT THOUSANDS OF DOLLARS ON TRAVEL TO ASSIST IN THE DEVELOPMENT OF ADEQUATE NATIONAL (AND INTERNATIONAL) REGULATIONS TO PROTECT UNKNOWING CITIZENS FROM THESE HAZARDOUS (YET FUN, PLAYFUL LOOKING…) PRODUCTS…. NATIONAL FIRE AND BUILDING CODE ORGANIZATIONS LIKE THE NFPA – NATIONAL FIRE PROTECTION ASSOCATION AND THE ICC – INTERNATIONAL CODE COUNCIL. THE NFPA ORGANIZATION IS LARGELY DOMINATED BY INDUSTRY REPRESENTATIVES ALONG WITH THE FIRE PROTECTION SPECIALISTS. EVEN ALL THOSE EXPERTS STRUGGLED FOR YEARS TO AGREE ON A SAFE WAY TO SELL FIREWORKS IN A SPACE ACCESSIBLE TO THE PUBLIC. THE INTERNATIONAL CODE COUNCIL -(PRODUCES THE INTERNATIONAL BUILDING CODE AND THE INTERERNATIONAL FIRE CODE – THE BASIS FOR THE OHIO BUILDING CODE AND THE OHIO FIRE CODE.)- ADOPTED THE SAFEST APPROACH AND SIMPLY MANDATED THAT THE PUBLIC BE SEPARATED FROM ANY LIVE FIREWORKS. THINK ABOUT HOW SOME STATES HAVE TENTS OR TRAILERS SET UP AT A CORNER POPUP STAND TO SELL FIREWORKS….THE PUBLIC CAN BE KEPT SAFELY AWAY FROM THE DANGER. WHY WOULD YOU EVEN CONSIDER PUTTING SUCH DANGEROUS ITEMS (WELL, THEY LOOK LIKE FUN…) IN YOUR NEIGHBORHOOD WALMARTS?

PUBLIC COULD OBTAIN A LICENSE TO SELL FIREWORKS FROM UNDER A TENT, THEN THE LUCKY FEW WITH THE STATE SUPPORTED MONOPOLY TO MAKE MILLIONS EACH YEAR WOULD LOSE THEIR PRECIOUS REVENUE…

NOT ONE OHIO FIRE CODE OFFICIAL OFFERED TESTIMONY ON PENDING CODE CHANGES. NOTABLY, THE STATE FIRE MARSHAL SHOWED UP TO SHAKE HANDS. WOW, WHAT A CONTRAST TO THE PERIOD WHERE I ADAPTED THE OHIO FIRE CODE TO THE NEWLY PROMULGATED INTERNATIONAL FIRE CODE. FOR OVER A DECADE I SUBMITTED CODE CHANGES TO THE ICC AND PROVIDED TESTIMONY AT EACH CODE DEVELOPMENT HEARINGS, OFTEN TRAVELING ON MY OWN TIME AND EXPENSE. MOREOVER, THE INDUSTRY MAINTAINED THAT NO SIGNIFICANT LIVE FIREWORKS TESTING WITH SPRINKLER SYSTEMS HAD YET OCCURRED, EXCEPT FOR A FEW SMALL-SCALE TESTS OF A FEW ITEMS THAT LED THEM TO CONCLUDE THAT A “STANDARD” SPRINKLER SYSTEM WOULD ADEQUATELY PROTECT THEIR DANGEROUS EXPLOSIVES…
